English Terms and Conditions

Terms and Conditions for purchasing WeStřik through the WeStřik online store. Effective from 15 July 2026.

WeStřik is an alcoholic beverage. Purchase and handover are intended only for persons over 18 years of age.

1. Seller and contact details

These Terms and Conditions govern the rights and obligations between the seller, Gastro Lovčenka s.r.o., registered address K vodě 3200/6, Záběhlice, 106 00 Prague 10, Czech Republic, ID No.: 17596343, VAT ID: CZ17596343, registered in the Commercial Register under file No. C 373705 maintained by the Municipal Court in Prague, e-mail: info@westrik.cz, phone: +420 735 117 497, website: https://www.westrik.cz, and the customer placing an order through the WeStřik online store.

Complaints and withdrawal requests are handled at reklamace@westrik.cz. Invoicing and tax-document requests are handled at fakturace@westrik.cz.

2. Introductory provisions

These Terms and Conditions apply to purchases made through the WeStřik online store.

WeStřik sells alcoholic beverages. Purchase, receipt and further handling of the goods are not intended for persons under 18 years of age.

By submitting an order, the customer confirms that they have read, understood and agree to these Terms and Conditions.

If the customer purchases as an entrepreneur, provisions intended exclusively for consumers, especially the right of withdrawal within 14 days, do not apply unless individually agreed otherwise.

3. Products and packaging

WeStřik is an alcoholic sparkling wine spritz / canned wine spritz in a 250 ml can with 4.2% alc./vol.

The online store enables the customer to select individual cans and assemble packs of 8, 16 or 24 cans from available flavors.

The customer may choose any mix of available flavors within the selected pack size. Availability of each flavor is subject to current stock displayed in the online store.

Current flavors include Grapefruit, Lemon, Mango and Elderflower.

Product details, volume, alcohol content, price, availability, composition, allergens, batch, minimum durability and storage conditions are displayed on the product page and/or on the packaging as required by applicable law.

Allergens: contains sulphites. Minimum durability: 9 months from the filling date. Responsible food business operator: Gastro Lovčenka s.r.o.

Storage conditions: Store in a dry place, protect from heat, frost and direct sunlight. Serve chilled. Consume immediately after opening.

Batch numbering system: LYYMMDD-X, where YYMMDD is the filling date and X is the flavor number. Examples: Grapefruit L260223-1, Lemon L260223-2, Mango L260223-3, Elderflower L260223-4.

4. Age restriction 18+

The sale of alcoholic beverages to persons under 18 years of age is prohibited.

The customer may place an order only if they are at least 18 years old.

By submitting an order, the customer confirms that they are over 18 years of age, that the information provided is true and that the alcoholic beverage will not be received by a person under 18 years of age.

The order process includes a mandatory age-confirmation checkbox. Without actively checking this box, the order cannot be confirmed or submitted.

Goods may be received only by a person over 18 years of age. For personal pickup, proof of age may be required.

The seller may refuse, cancel or refuse to hand over an order if there is a reasonable suspicion that the alcoholic beverage would be sold or handed over to a person under 18 years of age.

5. Order and conclusion of the purchase contract

The customer orders goods by selecting available flavors, assembling a pack of 8, 16 or 24 cans, proceeding to the payment/order area and completing the order process.

Before submitting the order, the customer can check and correct the entered data, selected flavors, number of cans, price and pickup method.

The order button is labelled "Order with obligation to pay" or by an equivalent clear wording.

By submitting the order, the customer makes a binding offer to conclude a purchase contract.

The purchase contract is concluded after payment and confirmation of the order by e-mail from the seller, unless stated otherwise in a specific case.

The seller archives the version of the Terms and Conditions valid at the time of the order.

The seller may refuse an order especially if the goods are unavailable, there is an obvious error in the price or description, the customer has not paid the price, the mandatory age confirmation has not been checked, or there is a reasonable suspicion of breach of the prohibition on selling alcohol to persons under 18.

6. Prices, VAT and unit price

Prices are stated in Czech crowns (CZK).

The seller is a VAT payer. Consumer prices are displayed including VAT unless expressly stated otherwise.

The product page displays the selling price including VAT. For the packaged beverage, the unit price per 1 litre is also displayed. If the price is displayed per pack, a price per can may also be displayed for customer convenience.

The price of the selected pack is displayed before the order is submitted and finally confirmed before payment.

The seller may change prices. Price changes do not affect already concluded purchase contracts.

In the event of an obvious pricing error, the seller is not obliged to deliver the goods at such erroneous price.

7. Payment terms

The customer may pay the purchase price using the payment methods displayed in the order process.

The payment gateway is Shopify Payments.

Available payment methods may include Shop Pay, Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay and Google Pay if available before payment.

Cash on delivery is currently not available.

Goods will be prepared for pickup only after successful payment unless expressly agreed otherwise.

The tax document/invoice will be sent by e-mail after the order is processed in the Money S3 accounting system.

8. Personal pickup

The current standard way of receiving an order is personal pickup at K vodě 3200/6, Prague 10 - HAMR Sport Záběhlice parking area.

The order may be picked up only after the customer receives a confirmation e-mail that it is ready for pickup.

For personal pickup, proof of age of the person receiving the goods may be required. If the person receiving the goods does not prove that they are over 18, or if there is a reasonable suspicion that the goods are to be handed over to a person under 18, the seller may refuse to hand over the goods.

Delivery to address is not currently a standard part of the online store offering. If delivery is launched in the future or individually agreed, only methods allowing compliance with the requirement to sell and hand over alcoholic beverages only to persons over 18 will be used.

9. Withdrawal by consumers

A consumer customer has the right to withdraw from a purchase contract concluded through the online store within 14 days from the date of receipt of the goods.

Withdrawal may be sent to reklamace@westrik.cz or in writing to Gastro Lovčenka s.r.o., K vodě 3200/6, Záběhlice, 106 00 Prague 10, Czech Republic.

The customer must return the goods to the seller without undue delay and no later than 14 days after withdrawal.

In the event of withdrawal, the customer bears the cost of returning the goods unless agreed otherwise.

The seller will refund the funds using the same payment method unless expressly agreed otherwise and may wait until the returned goods are received or proof of return is provided.

Opened, damaged or partially consumed cans are not accepted under withdrawal from the contract. They are accepted only in the case of a defect complaint. This does not affect statutory rights arising from defective performance.

10. Complaints and defects

The seller is liable to the customer that the goods are free from defects upon receipt and conform to the purchase contract.

Complaints may be submitted by e-mail to reklamace@westrik.cz or in writing to Gastro Lovčenka s.r.o., K vodě 3200/6, Záběhlice, 106 00 Prague 10, Czech Republic.

The complaint will be handled without undue delay and no later than 30 days from its submission, unless the seller and the customer agree on a longer period.

11. Privacy and cookies

12. Out-of-court dispute resolution

If a consumer dispute arises between the seller and a consumer customer and cannot be resolved by agreement, the customer may contact the Czech Trade Inspection Authority as the competent body for out-of-court consumer dispute resolution.

13. Final provisions

Legal relations between the seller and the customer are governed by the law of the Czech Republic.

If the customer is a consumer, this does not affect the customer's rights arising from mandatory provisions of applicable law.

If any provision of these Terms and Conditions is invalid or ineffective, this does not affect the validity of the remaining provisions.

The seller may amend these Terms and Conditions. For each order, the version effective at the time of order submission applies.

These Terms and Conditions become effective on 15 July 2026.
